Mamie Stathatos recently prevailed in a hearing against the NYS Justice Center for the Protection of People with Special Needs. The intensive hearing lasted three days, with six fact witnesses and two experts called upon to give testimony. At the conclusion of the hearing, the administrative law judge properly found that the Justice Center failed to show by a preponderance of the evidence that the mental health professional committed any prohibited acts with respect to his use of a restraint.
Since the formation of the Justice Center in 2013, Ms. Stathatos has been at the forefront in defending mental health professionals targeted by the Justice Center. Under Ms. Stathatos’ leadership, VBP&P represents numerous mental health facilities throughout the New York metropolitan area in proceedings brought by the Justice Center.
