Damien Smith has over 20 years of litigation experience. He brings the unique perspective of having represented both plaintiffs and defendants in his career. He began his legal career representing defendants in medical malpractice and nursing home long-term care litigation while working at two prestigious defense firms in New York. He has represented major hospital systems, individual physicians, chiropractors, dentists, podiatrists, various health care professionals, and nursing homes.
Damien pivoted to representing plaintiffs for over 10 years at one of the most prestigious plaintiffs’ firms in New York. There, he represented clients in medical malpractice, long-term care litigation, and personal injury suits. Damien handled all aspects of litigation from intake and investigation through discovery and trial. He has obtained several jury verdicts. He also has experience in appellate practice. Damien was the lead attorney in the Nursing Home Department.
Damien has been a presenter at various Continuing Legal Education programs instructing attorneys on aspects of medical malpractice and nursing home litigation. He has served as a judge in St. John’s School of Law’s moot court program. He volunteered to provide pro bono legal services to the victims of Hurricane Sandy.
Damien graduated from St. John’s School of Law in 2004. He attended law school at night while working as a New York State Court Officer, where he worked in various courts throughout New York over the span of approximately 10 years.
