Gregg D. Weinstock, Gunjan Persaud and Jeremy K. Moldovan Secure Summary Judgment in Bronx County Slip-and-Fall Action

On June 29, 2026, Gregg D. Weinstock, Gunjan Persaud and Jeremy K. Moldovan won a motion for summary judgment on liability on behalf of a major construction company contracted to perform work for the City of New York. Our motion sought dismissal of the complaint alleging negligence against the construction company in its entirety. The matter centered on plaintiff’s allegations of a dangerous or hazardous condition and defendant’s alleged failure to remedy the same, despite alleged actual or constructive notice, resulting in a right elbow fracture requiring internal fixation surgery and bilateral knee pain following plaintiff’s slip and fall.

The Court concluded that, despite plaintiff’s efforts to implicate our client, the defense established through the record a prima facie showing that the construction company bore no liability for plaintiff’s fall because it did not perform any construction work in the area of plaintiff’s fall, did not create the alleged defective condition, and did not breach any duty owed to plaintiff. The Court granted our motion for summary judgment on liability and dismissed plaintiff’s complaint and all cross-claims asserted against our client.
