On April 21, 2025, Gunjan Persaud and Mamie Stathatos-Fulgieri won a motion for summary judgement on liability on behalf of a nursing home, dismissing a medical malpractice claim against the nursing home in its entirety. The matter centered upon plaintiff’s allegations of medical malpractice for defendant’s purported improper wound care, resulting in pressure ulcers, sepsis, and death. The Court concluded that the defense diligently established, through their expert affirmation, extensive analysis of medical records and deposition testimonies, that defendant provided a prima facie showing that the nursing home had appropriately treated plaintiff’s condition and did not proximately cause the injuries as alleged, despite plaintiff’s efforts to implicate our client. Specifically, the Court held that the plaintiff’s pressure ulcers did not develop until three years after the nursing home was sold to co-defendant, and as such plaintiff failed to establish any deviations from the standards of care or establish defendant nursing home was the proximate cause of the alleged injuries. Following oral arguments, the Court granted our motion for summary judgement on liability, finding that there was no triable issue of fact as to the defendant’s liability, treatment rendered or whether defendant was the proximate cause of plaintiff’s injuries. Accordingly, the Court awarded summary judgement in its entirety, dismissing plaintiff’s Complaint as to defendant nursing home.
