On May 23, 2016, partner Jeffrey Nichols secured a unanimous defense verdict in Nassau County Supreme Court on behalf of a board certified urologist. Mr. Nichols’ client performed surgery on the plaintiff to address pelvic organ prolapse. Plaintiffs’ counsel alleged that four subsequent surgeries were required to address ongoing issues from the use of mesh to address the underlying prolapse. Mr. Nichols successfully demonstrated that the underlying surgery was indicated and appropriately performed.
Additionally, on April 26, 2016, Mr. Nichols secured a discontinuance on behalf of a Brooklyn based hospital during trial in Kings County Supreme Court. The plaintiff in the case suffered complications during a laparoscopic surgery. Mr. Nichols effectively impeached the plaintiff with prior deposition testimony from the case, as well as from testimony in a collateral lawsuit, leading to a favorable disposition.
