On May 12, 2025, Ralph Morales, Daniel O’Connell, and Jesse Wang prevailed in a motion for summary judgment and dismissal of plaintiffs’ Complaint in its entirety pursuant to CPLR 3212 in Queens County Supreme. The medical malpractice action was premised upon allegations of lack of informed consent and improper performance of an exploratory laparotomy and incisional hernia repair, resulting in a perforated bladder. In the motion papers and upon oral argument, the defense team argued that the defendants’ care and treatment were at all times consistent with the standard of care and the defendants’ actions were not the proximate cause for the plaintiff’s injuries. The defense further cited extensively to the record, expert affirmation, and deposition testimony to demonstrate that the defendants properly obtained plaintiff’s informed consent and the post-operative outcomes, including lacerations to the bladder, were known risks that were not due to any negligence on the defendants’ part, as the surgery at issue was performed properly. Ultimately, the Court agreed with the defense and granted the summary judgment in its entirety, finding that defendants established a prima facie entitlement to summary judgment and plaintiffs, in opposition, failed to raise a triable issue of fact.
