Robert Boccio and Rachel McGarry obtained summary judgment on behalf of our dentist client in a medical malpractice action involving allegations of negligent dental implant placement and teeth removal resulting in implant removal, bone grafts, crowns, and the alleged need for full mouth reconstruction.

Our team demonstrated that implant placement was appropriate, and that the removal of plaintiff’s teeth was necessary given the condition of plaintiff’s dentition. While one of plaintiff’s implants failed, our team established that the implant failure was not due to negligence by our client. Additionally, the evidence established that plaintiff’s alleged injuries were attributable to plaintiff’s failure to return for follow-up treatment as recommended by our client.

Following review of the motion papers, the Court granted our motion for summary judgment, dismissing all claims against our client.
