On October 22, 2024, Scott Singer secured a unanimous defense verdict before Judge Wavny Toussaint of the Supreme Court of Kings County. The plaintiff, who had a long history of recurring joint infections in her hip, claimed that the defendant orthopedic surgeon negligently performed hip reconstruction surgery while she still had an ongoing infection. She alleged that this led her to undergo a hemipelvectomy (a surgery involving removal of not only the leg but half the pelvis) a year and a half later.
Mr. Singer successfully refuted this claim by arguing that the defendant had initially diagnosed an infection, which led him to delay the hip reimplantation by a month while the plaintiff underwent antibiotic treatment to eradicate it. By the time the hip reconstruction was performed, all tests indicated there was no active infection in the plaintiff’s hip. Plaintiff later treated with numerous other doctors but never contacted or returned to the defendant. Mr. Singer successfully argued both the reconstructive surgery and informed consent were appropriate and there was no causal relationship between the defendant’s surgery and the plaintiff’s later decision to undergo a hemipelvectomy.
